เฟซบุ๊กเพจ “มนุษย์ควัน” เผยวุฒิสภาฟิลิปปินส์ผ่านร่างกฎหมายยาสูบไร้ควัน ตั้งเป้าควบคุมการใช้บุหรี่ไฟฟ้าและผลิตภัณฑ์แบบให้ความร้อน เพื่อไม่ให้เด็กเข้าถึงได้ ขณะที่เปิดทางให้สิงห์นักสูบผู้ใหญ่ 17 ล้านคนมีโอกาสได้ใช้ผลิตภัณฑ์ทางเลือกที่อันตรายน้อยกว่า ชี้รัฐสภาไทยและรัฐบาลควรดูเป็นตัวอย่าง
นายสาริษฏ์ สิทธิเสรีชน เจ้าของเฟซบุ๊กเพจ “มนุษย์ควัน” ซึ่งมีผู้ติดตามกว่า 30,000 คนที่รณงรงค์เรียกร้องสิทธิในการเข้าถึงผลิตภัณฑ์ไร้ควัน เผยความคืบหน้าล่าสุดเกี่ยวกับการออกกฎหมายผลิตภัณฑ์นิโคตินแบบไม่เผาไหม้ หรือ Vaporized Nicotine Product bill ในประเทศฟิลิปปินส์ว่า “วุฒิสภาฟิลิปปินส์เพิ่งผ่านร่างกฎหมายนี้เป็นที่เรียบร้อยมื่อสัปดาห์ก่อน หลังจากที่ก่อนหน้านี้สภาผู้แทนราษฎรของฟิลิปปินส์ก็มีมติเห็นชอบในร่างกฎหมายนี้มาแล้ว ซึ่งสภาฯฟิลิปปินส์เชื่อว่าจะช่วยลดอัตราการสูบบุหรี่ในประเทศได้ และยังจะช่วยให้คนสูบบุหรี่กว่า 17 ล้านคนในฟิลิปปินส์มีโอกาสเปลี่ยนไปไปใช้ผลิตภัณฑ์ที่เป็นอันตรายน้อยกว่าการสูบบุหรี่”
ร่างกฎหมายผลิตภัณฑ์นิโคตินแบบไม่เผาไหม้ มีสาระสำคัญเพื่อควบคุมการนําเข้า ผลิต ขาย การบรรจุ การจัดจําหน่าย การใช้และการบริโภคบุหรี่ไฟฟ้าและผลิตภัณฑ์ยาสูบแบบให้ความร้อน (HTPs) ตามมาตรฐานที่เป็นที่ยอมรับในระดับสากล เพื่อป้องกันประชาชนจากอันตรายของผลิตภัณฑ์ที่มีคุณภาพต่ำกว่ามาตรฐาน
“ปัจจุบัน ฟิลิปปินส์ยังไม่มีกฎหมายเฉพาะที่ใช้ควบคุมบุหรี่ไฟฟ้าและผลิตภัณฑ์ยาสูบแบบให้ความร้อนแต่ก็มีการใช้อย่างแพร่หลายในประเทศ เลยจำเป็นต้องมีการออกกฎหมายเพื่อควบคุมให้ถูกต้อง ซึ่งเป็นแนวทางเดียวกับ 79 ประเทศทั่วโลก เช่น อังกฤษ สหภาพยุโรป หรือสหรัฐอเมริกา คือการมีมาตรการควบคุมที่เฉพาะสำหรับผลิตภัณฑ์กลุ่มนี้เลย แต่ประเทศไทยกลับเลือกที่จะแบนบุหรี่ไฟฟ้าและผลิตภัณฑ์ยาสูบแบบให้ความร้อน โดยไม่ดูความต้องการของผู้สูบบุหรี่ที่มองหาผลิตภัณฑ์ทดแทนการสูบบุหรี่ที่อันตรายน้อยกว่า ดังนั้นการแบนจึงไม่ได้ผล เพราะก็ยังมีคนแอบซื้อ แอบใช้ จำนวนมาก ซึ่งอาจรวมถึงเด็กๆ และเยาวชนด้วย มีการขายกันเกลื่อนในโลกออนไลน์ แถมรัฐเก็บภาษีสรรพสามิต หรือภาษีศุลกากรก็ไม่ได้เลย”
“เครือข่ายผู้บริโภคหลายองค์กรในฟิลิปปินส์ออกมาชื่นชมการผ่านร่างกฎหมายในครั้งนี้ เพราะแสดงให้ถึงการรับฟังเสียงของประชาชน เราเองก็อยากให้หน่วยงานของไทยเช่น กระทรวงการคลัง กระทรวงดิจิทัลฯ กรมสรรพสามิต กรมศุลกากร หรือแม้กระทั่งคณะกรรมาธิการของสภาผู้แทนราษฎรให้มีการถกเถียงและแก้ปัญหาเรื่องผลิตภัณฑ์ไร้ควันของประเทศไทยบ้าง จะได้หาทางควบคุมผลิตภัณฑ์เหล่านี้ให้ถูกกฎหมาย แก้ปัญหาคอรับชั่นธุรกิจใต้ดิน และการแอบซื้อของเด็กและเยาวชน ที่เป็นปัญหาอยู่ในทุกวันนี้เพราะการแบนที่ล้มเหลวมาตลอด 7 ปี”
“Manoodkwan” Reveals Philippine Senate Passes Law to Legalize, Control E-Cigarettes
Facebook Page “@manoodkwan” discloses that the Senate of the Philippines has already cleared the Vaporized Nicotine Product Bill with aim to control e-cigarette and heated tobacco product (HTP) usage. While the control will bar children from accessing such products, it will offer 17 million smoking adults access to products that are less harmful than cigarettes. The Thai Parliament and government are told to follow in the footsteps of the Philippines.
Mr. Sarit Sittisereechon, administrator of Facebook page ‘@manoodkwan’ that has more than 30,000 followers and campaigns for access to smokefree products, gives an update about the Philippines’ legislation of the Vaporized Nicotine Product Bill. Earlier, it was reported that the Philippines’ House of Representatives had already approved the bill out of beliefs that such law would lower smoking rate and offer less harmful alternatives to more than 17 million smokers in the country. In essence, the bill seeks to control the import, production, sale, packaging, distribution, usage, and consumption of e-cigarettes and heated tobacco products (HTPs) based on international standards so as to protect people from substandard products.
“Presently, the Philippines has not yet had a specific law for the control of e-cigarettes and HTPs but such products have already been widely used in the country. Therefore, the Philippines thinks it is necessary to pass a law to properly control such products just like what 79 other nations, such as Britain, EU nations and the United States, have done. So many countries have introduced a specific law to control e-cigarettes and HTPs. Yet, Thailand has chosen to ban both e-cigarettes and HTPs, ignoring smokers’ need to find less harmful alternatives. Thailand’s ban, as a result, proves ineffective. A huge number of people, possibly including children and youth, have secretly bought and used e-cigarettes and HTPs. Their distribution is rampant in the online world with neither excise taxes nor customs taxes paid”.
“Several consumers’ networks based in the Philippines have praised the legislation of the Vaporized Nicotine Product Bill because it shows authorities have listened to the voice of people. We hope Thai agencies such as the Finance Ministry, the Digital Economy and Society Ministry, the Excise Department, the Customs Department, and House committees have discussions on how to solve HTP issues. Such discussions can lead to the proper and legal control of HTPs, ending corruption, black market, and purchases by minors. These many problems have raged on for seven years now because e-cigarette/HTP ban here is a complete failure,” Mr. Sarit adds.
